The Role:
Providing a Terminal Schedule of Dilapidations
Client:
Local council property - Twyford Road, Eastleigh, Hampshire
The Brief:
Sillence Hurn were appointed to inspect the property and review the lease and provide a terminal schedule of dilapidations on an industrial unit with a dedicated office block for service on the outgoing tenant.
Timescales were tight and we were required to inspect the unit at short notice and produce the schedule in a short turnaround time.
Project Outcomes:
We provided the schedule to the Landlord in good time to allow them to serve the schedule on the Tenant via their legal team within the parameters set out in the lease.
There was a lengthy schedule of condition appended to the lease which required detail review in connection with drafting the dilapidations claim. We provided advice on the extent of consequential losses (i.e loss of rent, rates) in the context of the claim.
We provided added value to our service by providing informal advice before our appointment by reviewing the lease and discovering a lease clause around specific reinstatement provisions.
We subsequently recommended that the Landlord serve formal notice on the tenant for the reinstatement of their alterations ahead of lease expiry which would allow them to claim for these items within the dilapidations claim after lease expiry.
